The Assistant Commissioner of Police, K.R.Puram
Sub-Division, Bengaluru has filed the charge sheet
against the accused for the alleged offences punishable
under Sections 353, 332 and 307 of IPC.
2. The learned Magistrate after complying with the
provisions under Section 207 Cr.P.C., has committed the
case against the accused under Section 209 of Cr.P.C.,
to the Court of Hon’ble Prl. City Civil & Sessions Judge,
Bengaluru, as the offense under Section 307 of IPC are
exclusively triable by the Court of Sessions. After
committal of the case, the case is made over to this
court for trial in accordance with law.
3. The brief facts of the prosecution case are as
under:
That on 10.12.2012 at about 9-45 p.m., when
C.W.14 was feeding food to her child in front of
her house situated at 3rd ‘A’ Cross, 7th ‘C’ Main,
1st Block, HRBR Layout, within the limits of
Banasawadi Police Station, Bengaluru, the
accused was the pillion rider of the Honda Activa
bearing No.KA-53-U-6859 came there and
snatched her gold chain and fled away from the
spot and was hiding in the bushes. When C.W.2
tried to catch him, the accused had fisted on the
face of C.W.2 with his hands, resulting which he
sustained injury on his right eye. When C.W.1
tried to apprehend the accused, the accused
pushed him and obstructed him from discharging
his official duty. Later C.W.1 told the accused
that they are police and asked him to surrender
before them. At that time the accused had
threatened C.W.1 that if he tried to catch him, he
will not spare him by showing knife and assaulted
C.W.1 with a knife causing bleeding injury on his
right forearm and thus attempted to commit the
murder of C.W.1. Thereby the accused is alleged
to have committed the offences punishable under
Sections 353, 332 and 307 of IPC.
