Udham Singh Nagar.
4. I t is cont ended in t he short t erm
bail applicat ion t hat wife of t he present
applicant is hospit alized in Dist rict
Hospit al Kanpur since last one m ont h
and her condit ion is serious as she has
been diagnosed wit h gast rosepsis wit h
acut e kidney inj ury, chronic cholecyst it is
wit h cholelit hiasis wit h right renal cyst
wit h chronic cyst it is. I t is also subm it t ed
t hat Doct or advised surgery of t he wife
of t he applicant . He subm it s t hat t here
was a love m arriage of t he present
applicant and no ot her fam ily m em ber of
his fam ily is support ing him , however,
m ot her- in- law of t he applicant is
support ing him who filed an affidavit in
support of t he inst ant short t erm bail
applicat ion.
5. Mr. Pal, learned A.G.A. subm it s t hat
t he officials have verified t his m edical
report and t he disease which has been
diagnosed is correct and she has been

advised t o undergo surgery.
6. Aft er hearing t he learned counsel
for t he part ies and furt her t aking int o
considerat ion t hat t he wife of t he
applicat ion is diagnosed wit h
gaest rosepsis wit h acut e kidney inj ury,
chronic cholecyst it is wit h cholelit hiasis
wit h right renal cyst wit h chronic cyst it is
and advised for surgery t his Court is of
t he view t hat t he applicant deserves
short t erm bail for a period of t hree
m ont hs.
7. Accordingly, short t erm bail
applicat ion is allowed.
8. Let t he applicant Abhinav Raj Singh
Sengar be released on short t erm bail for
a period of t hree m ont hs, t o be reckoned
from t he dat e of his release, on his
execut ing a personal bond and furnishing
t wo reliable suret ies of t he like am ount
to t he sat isfact ion of t he court
concerned.
8. Needless t o say on com plet ion of
period of t hree m ont hs, from t he dat e of
release, he shall surrender before t he
learned t rial court . On such an event he
will be rem anded t o t he cust ody. I f he
does not surrender, proper warrant shall
be issued against him .
