1. Instant criminal revision petition under Section 397/401
Cr.P.C. has been filed by the petitioner against the judgment dated
27.04.2005 passed by learned Additional District & Sessions Judge
(Fast Track) No.2, Bikaner in Sessions Case No.65/2003, whereby
the learned Judge acquitted the respondents No.6 & 7 from
offences under Sections 147, 148, 307/149, 325/149, 323 & 341
IPC by giving benefit of doubt to them. The respondents No.2 to 5
[2025:RJ-JD:33709] (2 of 6) [CRLR-819/2006]
were acquitted from the offences under Sections 147, 148 &
325/149 IPC.
2. Brief facts of the case are that on 03.12.2001, complainant
Jasnath submitted a Parcha Bayan alleging that at about 07.30 PM
when Bhanwar Nath was going home, he was attacked by the
present appellants along with two other accused. They assaulted
Bhanwar Nath with lathis & other weapons and upon intervening
by the complainant, he was also hit by Om Nath. Due to such
assault, Bhanwar Nath received injuries on various body parts and
was admitted to the hospital. On this report, Police registered a
case against the accused respondents and started investigation.
