The instant criminal miscellaneous petition under Section

528 BNSS (482 Cr.P.C.) has been preferred by the petitioners for

quashing the FIR No.39/2023 registered at Police Station Gangrar,

District Chittorgarh for the offences under Sections 143, 341 and

307 IPC.

Learned counsel for the petitioners submitted that though

initially the FIR has been lodged against the petitioners for the

offences punishable under Sections 143, 341 and 307 IPC but

during the course of investigation, only the offences punishable

under Sections 341, 506 and 34 IPC have found to be made out

against the petitioners.

Learned counsel submitted that the matter has already been

compromised by the parties and it is borne out from the

compromise that the respondent No.2 is not inclined to proceed

further in the matter. Learned counsel has placed reliance on a

decision of Hon’ble the Supreme Court in the case of Gian Singh

Vs. State of Punjab & Anr. reported in (2012)10 SCC 303. In

these circumstances, the FIR lodged by the respondent No.2

against the petitioners may be quashed.
