Plaintiff has filed present suit seeking the relief of

declaration.

2. Case of the plaintiff in brief is as under:-

The suit schedule property is piece and parcel of

the Apartment/Flat bearing No. GF-001, Ground Floor, 3

Bedroom Flat in multi-storied apartment building named

as Usha Enclave with super built up area of 1100

O.S.No.4372/2021

Square Feet. Suit schedule property is one among

other flats being built in the entire site bearing No.54 and

defendant No.5 was informed as the owner of entire

land in which suit schedule property is built. During May-

June 2015, plaintiff was intending to purchase

Flat/Property for his own use and occupation.

Defendant No.2 the office Colleague of the plaintiff

suggested him that he has connection with Real Estate

Agents and introduced defendants No.3 and 4 and

thereafter defendants No.3 and 4 represented that there

are many vendors upcoming and some are under

construction. Plaintiff informed them to show any Flat at

reasonable price in good location and they said that

there is an Apartment namely Usha Enclave at

Rajarajeshwari Nagar, Pattanagere Village, Bengaluru

South Taluk, measuring 1100 Sq.Ft. super built up area

at a reasonable price and initially shown said apartment

O.S.No.4372/2021

to plaintiff and thereafter said Flat was finally negotiated

to Rs.52,50,000/-.
