1. The instant second bail application has been filed by the

applicant under Section 483 BNSS (439 Cr.P.C.). The applicant

has been arrested in connection with FIR No. 41/2025

registered at Police Station Osiyan, District Jodhpur for the

offence(s) under Section 115(2), 109(1), 117(2) and 3/5 of

BNS 2023.

2. Learned counsel for the accused-applicant submits that the

applicant has been falsely implicated in the case. He further

submits that first bail application was dismissed as not pressed by

this Court on 10.03.2025 in SB Criminal Misc. Bail Application No.

2352/2025 with liberty to file fresh bail application after filing of

charge-sheet. Now, the charge-sheet has been filed and he

submits that as per final opinion in injury report, grievous injury

was found only on fingers and other two injuries are simple in

nature. The applicant is behind the bars. The trial may take long

time to conclude. Thus, learned counsel submitted that the

applicant may be enlarged on bail.
