Heard Mr. Avanish Kumar Singh, learned counsel for

the appellant, Mr. V.N.P. Sinha, learned Senior Counsel for the

Economic Offence Unit and Mr. Manish Kumar, learned APP

for the State.

2. Records of this case have been placed before this

Court to consider the prayer of the appellant for suspension of

his sentence and release on bail during pendency of the appeal.

3. The appellant has been convicted vide judgment

dated 05.06.2024 and sentenced vide order dated 12.06.2024

passed by learned Exclusive Special Court (N.D.P.S., Act) No.-

2, Patna in Special (N.D.P.S.) Case No. 114 of 2018 and 159 of
Patna High Court CR. APP (DB) No.932 of 2024(7) dt.23-04-2025

2018 arising out of Economic Offences P.S. Case No. 13 of

2018 for the offence under Sections 20(b)(ii) (C) and 29 of

Narcotic Drugs and Psychotropic Substances Act (in short

‘N.D.P.S. Act’), 1985. He has been ordered to undergo

imprisonment for 13 years with a fine of Rs. 2,00,000/- under

Section 20(b) (ii) (C) of N.D.P.S. Act. Further, he has been

ordered to undergo imprisonment for 12 years along with a fine

of Rs. 1,00,000/- under Section 29 of the N.D.P.S. Act. In

default of fine, he shall further undergo imprisonment for a

period of six months. All the sentences are to run concurrently.
