   1.       1.     This matter is taken up through hybrid mode.

2. The petitioners in this writ petition pray for the following

reliefs:-

“The Petitioners, therefore, humbly pray Lordship shall
graciously be pleased to admit that your this Writ petition &
to issue Rule NISI to the opposite parties to show cause as to

1. Why the opposite parties will not be directed to settle
the case land in respect of Hal plot 31 (p), Hal plot 32 (p),
Hal plot 33 (p), Hal plot 34 (p), Hal plot 39 (p)
Ac0.2.22dec. under Hal khata 3 of Mouza- Nipania, Tahasil
/P.S-Mahakalapara, Dist-Kendrapara infavour of the
petitioners by changing the Kisam from Jungle Due to
Sarad-2.

2. Why the opposite party 3 will not be directed to
dispose of the representation Vide Annexure -2 in order
to look into the grievance of the petitioners for taking a
decision following the provisions contained in the OGLS
Act
within a stipulated period.

And may pass any other order/orders direction/directions
as the Hon’ble court deem fit and proper.
And for which act of kindness, the petitioners as in duty
bound, shall ever pray.”

3. The petitioners essentially seek to change the kisam of land

recorded in the name of their father from kisam ‘Jungle’ to

‘Sarad-2’.

4. In course of hearing, Mr. Lambodar Pradhan, learned

counsel for the petitioners submits that there are some

fundamental defects in the writ petition.

5. In view of the above, he prays for withdrawal of the writ

petition to file a fresh one with better particulars.

6. Without expressing any opinion on the merits of the case of

the petitioners, this Court disposes of the writ petition as

withdrawn, with a liberty to file a fresh one with better particular

within a period of one month hence.

7. Urgent certified copy of this order be granted on proper

application.
