The petitioners have invoked supervisory jurisdiction of this Court, in

terms of Article 227 of the Constitution of India, for the enforcement of orders

dated 12.11.2024 and 09.01.2025 passed by learned Sub Judge, Special Railway

Magistrate, Jammu [” the trial Court”], in a Civil Suit titled “Bindu Singh Jamwal

and another Vs. Chanchal Sing & Ors”, primarily on the ground that, despite

various directions issued by the trial Court from time to time, the police Agency

and Revenue officials have failed to implement the aforesaid orders.

Ordinarily, parties are obliged to approach the concerned Court for

implementation its orders and the said Court shall ensure that the orders passed by

it are implemented in letter and spirit. It appears that petitioners have already

approached the trial Court, by way of a contempt petition against the erring

officers/officials for enforcement of the aforesaid orders, however, the Police and

the Revenue authorities have succeeded to procrastinate the issue on one excuse

or the other.

Having regard to the limited nature of controversy, the present petition

is disposed of with a direction to the trial Court to ensure that the orders passed by

it are implemented in its letter and spirit within period of three weeks from the

date a copy of this order is made available, failing which trial Court shall initiate

contempt proceedings against the delinquent officers/officials.

Disposed of.
