This is a complaint filed by the complainant against the

accused for the offense punishable under section 138 of the

Negotiable Instruments Act.

2. The brief facts of the complainants’ case are as follows:

It is the case of the complainant that he and the accused

have been close friends for the past several years; both families

of the accused and the complainant are also close friends. The

accused used to share his problems with the complainant, and

he told him that he arranged the marriage of his daughter in

Kerala and he arranged part of the funds to perform the

marriage, and there was a shortage of funds, so he requested the

complainant for financial assistance. Considering the genuine

request, the complainant told the accused that he would arrange

the funds by selling his house property bearing no.240, situated

at Brindavan Layout, Settihalli, Jalahalli West, Bengaluru;

accordingly, the complainant sold the house property for Rs.

31,70,000/-, so he paid a hand loan of Rs. 30,00,000/- to the

accused in the following manner :
