This case arises out of the complaint filed by the
complainant against the accused under section 200 of
Cr.P.C,. for an offence punishable under section 138
read with section 141 and 142 of Negotiable Instruments
Act.
2. The case of the complainant’s in brief is as
under:
It is the case of the complainant is that the
complainant is a partnership firm and is engaged in
manufacturing and trading of M-sand and aggregates
since 2015. The accused is also a partnership firm
represented by its partners and is engaged in trading of
M-sand and aggregates. The partners of the accused
firm, approached the complainant in the year 2018 for
supply of M-sand. After mutual agreement between the
complainant and the accused, the complainant started
supplying M-sand from 02.04.2018. Further stated that
the accused used to place his demand for supply of M-
sand and the complainant had supplied the accused as
and when they have placed the requisition with the
complainant. Further the complainant supplied M-sand
to the accused regularly, as per requisition, from
02.02.2018 till 23.08.2021. The accused made regular
payment towards the supplies made by the complainant
till 18.06.2018. However, they failed to make payment
after 18.06.2018 till 23.08.2021. The total outstanding

amount due to the complainant from 19.06.2018 till
23.08.2021 for Rs.36,97,572.32/-.
