                      The learned counsel for the petitioners
               submits that the petitioners are arraigned as
               accused Nos.1 and 2 in Crime No.151 of 2024 on
               the file of Kadiri Rural U/G Police Station, for
               alleged offences under Section 108 of BNS read
               with 3(2),(v),(a) of SC/ST (POA) Act.
                      The learned counsel for the petitioners
               submits that the petitioners have traced the
               deceased and apprehended him in Crime No.238
               of 2021, for alleged offences under Sections 363,
               366(A), 376(ii)(n), 420 of IPC read with Sections 5
               and 6 of POCSO Act, 2012. It is submitted that the
               2nd respondent has filed a complaint alleging that

the petitioners have instigated his son to commit
suicide, and on the strength of the alleged suicide
note of the deceased, the petitioners are arraigned
as accused No.1, who is Investigating Officer in
Crime No.238 of 2021 and accused No.2, who is
Sub-Inspector of Police, Kurnool in the said crime.

The learned counsel for the petitioners
submits that the Sub-Divisional Police Officer,
Penukonda, had issued notice under Sections
35(3)
, (4), (5), (6) of BNSS, calling the 2nd Contd…..

petitioner to appear on 19.03.2025 at 05:00 P.M.,
at Sub-Divisional Police Officer, Penukonda.

The learned counsel for the petitioners
submits that the registration of crime under
Section 108 of BNS is false and that the alleged
incident of arrest of the petitioners in Crime
No.238 of 2021 in the year 2021. However, the
deceased committed suicide in the year 2025, and
as such the petitioners cannot be arraigned as
accused in Crime No.151 of 2024 and there is no
proximity on the petitioners to instigate the
deceased to commit suicide.

Considering the same, there shall be stay of
all further proceedings in so far as the petitioners
are concerned in Crime No.151 of 2024 on the file
of Kadiri Rural U/G Police Station.

Post the matters on 24.06.2025, for hearing.
