Mr. Bhupesh Kandpal, learned counsel for the
Applicant.

2. Mr. G.C. Joshi, learned AGA with Mr. Prabhat
Kandpal, Mr. Rakesh Negi, learned Brief Holders, for the
State of Uttarakhand/1.

3. In the present C528 Application filed under Bhartiya
Nagarik Suraksha Sanhita, 2023, the Applicant has put a
challenge to the impugned summoning order dated
15.05.2025, and the entire proceedings of Criminal Case
No.508 of 2015, “State Vs. Arvind Sharma & others” under
Sections 457, 427, 323, 504, 506, 448, 511 and 120-B of IPC,
which is pending before the court of learned Judicial
Magistrate, Vikas Nagar, District Dehradun.

4. Admit.

5. Considering the submissions advanced by the learned
counsel on behalf of the Applicant, an interference is being
called for in the matter.

6. Issue notice to the respondent no.2. Steps to be taken
within a week. Counter affidavit to be filed within a period of
three weeks.

7. Till the next date of listing, the impugned summoning
order dated 15.05.2025, and the entire proceedings of
Criminal Case No.508 of 2015, “State Vs. Arvind Sharma &
others” under Sections 457, 427, 323, 504, 506, 448, 511 and
120-B of IPC, which is pending before the court of learned
Judicial Magistrate, Vikas Nagar, District Dehradun, shall
remain stayed.

8. List this matter on 09th September, 2025.

9. Stay application (IA No.1 of 2025) stands disposed of
accordingly.
