2. Mr. G.C. Joshi, learned AGA with Mr. Prabhat
Kandpal, Mr. Rakesh Negi, learned Brief Holders, for the
State of Uttarakhand/1.
3. In the present C528 Application filed under Bhartiya
Nagarik Suraksha Sanhita, 2023, the Applicants have put a
challenge to the impugned cognizance/summoning order dated
04.06.2024, and the entire proceedings of Criminal Case
No.728 of 2024, “State Vs. Prince Singh and others” under
Sections 147, 148, 186, 332, 353 and 427 of IPC, and Section
7 Criminal Law (Amendment) Act, 1932, which is pending
before the court of learned Judicial Magistrate, Khatima,
District Udham Singh Nagar.
4. Admit.
5. Considering the submissions advanced by the learned
counsel on behalf of the Applicants, an interference is being
called for in the matter.
6. Issue notice to the respondent no.2. Steps to be taken
within a week. Counter affidavit to be filed within a period of
three weeks.
7. Till the next date of listing, the impugned
cognizance/summoning order dated 04.06.2024, and the entire
proceedings of Criminal Case No.728 of 2024, “State Vs.
Prince Singh and others” under Sections 147, 148, 186, 332,
353 and 427 of IPC, and Section 7 Criminal Law
(Amendment) Act, 1932, which is pending before the court of
learned Judicial Magistrate, Khatima, District Udham Singh
Nagar, shall remain stayed.
8. List this matter on 09th September, 2025.
9. Stay application (IA No.1 of 2025) stands disposed of
accordingly.
