Mr. Sanjay Kumar, learned counsel, holding brief of Mr.
Tapan Singh, learned counsel for the Applicant.
2. Mr. Rakesh Negi, learned Brief Holder, for the State.
3. The present application under Section 528 of BNSS has
been filed on behalf of the Applicant with a prayer to direct the
learned Trial Court to decide the Session Trial No.06 of 2021,
“State Vs. Sahnazar & others”, under Sections 147, 148, 452,
354, 308, 323, 504 and 506 of IPC, pending before the court of
learned 1st Additional District and Session Judge, Roorkee,
District Haridwar, as expeditiously as possible.
4. Learned counsel for the Applicant submits that the matter
is pending before the learned Trial Court since 2019 and the
case has not progress, as it should have been. The prayer seems
to be innocuous.
5. Learned Government Counsel points out that there are
few anomalies which need to be corrected. To this, learned
counsel for the Applicant makes an oral submission that if
permitted the correction so said to be made will be complied
with today itself.
6. Permission granted.
7. The present C528 application is disposed of with a
direction to the learned Trial Court to expedite the aforesaid
sessions trial as early as possible, in accordance with law.
