Mr. Pankaj Kumar Sharma, learned counsel for
the Applicants appearing through V.C.

2. Mr. Akshay Latwal, learned AGA for the State
of Uttarakhand.

3. Present C528 Application has been filed by the
Applicants Gullu Thekedar, son of Shaukat, Aslam
Thekedar, son of Ali Hasan and Arun Thekedar, son
of Dhoom Singh against respondent no.2 S.K. Tyagi,
Executive Engineer with the prayer for quashing the
impugned charge sheet dated 12.01.2024, summoning
order dated 12.04.2024 as well as the entire
proceedings of Criminal Case No.1045 of 2024 (case
crime no.750 of 2023) State vs. Gullu Thekedar and
others for the offence punishable under Section 186,
323, 332, 353, 427, 504 and 506 of IPC registered at
Police Station Kotwali Roorkee pending in the court
of Additional Chief Judicial Magistrate Roorkee,
District Haridwar. A further prayer has also been
made that during the pendency of present criminal
misc. Application the proceedings of the said criminal
case be stayed.

4. Learned counsel for the Applicant makes a
statement that the present matter is a cross case that is
also in relation with the proceedings relating to the
same construction work.

5. Admit.

6. Issue notice to respondent no.2 returnable at an
early date.

7. Steps to be taken within one week.

8. Let the objection be filed by the State within
two weeks.

9. List on 06.10.2025.

10. Having heard learned counsel for the parties, as
an interim measure, till the next date of listing entire
proceedings of Criminal Case No.1045 of 2024 (case
crime no.750 of 2023) State vs. Gullu Thekedar and
others for the offence punishable under Section 186,
323, 332, 353, 427, 504 and 506 of IPC pending in
the court of Additional Chief Judicial Magistrate
Roorkee, District Haridwar shall remain stayed.
