2. Mr. Prabhat Kandpal, learned Brief Holder, for the State of
Uttarakhand/1.
3. Mr. Avtar Singh Rawat, learned senior counsel for the
private Respondent No.2.
4. The present application under Section 528 of BNSS
has been filed on behalf of the Applicants, against the
Respondent No.2, challenging the entire proceedings of
Criminal Case No.414 of 2023, “Arjun Sharma Vs. State &
others“, under Sections 406, 467, 468, 471, 506 and 120-B of
IPC against Applicant No.1 and 506 and 120-B of IPC against
Applicant Nos.2 and 3, pending in the court of learned 3rd
Additional Chief Judicial Magistrate, Dehradun, be quashed.
5. Considering the submissions advanced by the learned
senior counsel on behalf of the Applicants, an interference is
being called for in the matter.
6. Admit.
7. One week time is granted to the Respondents to file
counter affidavit
8. Till the next date of listing, the entire proceedings of
Criminal Case No.414 of 2023, “Arjun Sharma Vs. State &
others“, under Sections 406, 467, 468, 471, 506 and 120-B of
IPC against Applicant No.1 and 506 and 120-B of IPC against
Applicant Nos.2 and 3, pending in the court of learned 3rd
Additional Chief Judicial Magistrate, Dehradun, shall remain
stayed.
9. List this matter on 08th August, 2025.
10. Stay application (IA No.1/2025) stands disposed of
accordingly.
