4. Present application has been filed by the
Applicant under Section 528 of B.N.S.S. for
quashing the Charge sheet dated 16.02.2024 as
well as the cognizance/summoning order dated
17.02.2024 as well as the entire proceedings of
Sessions Trial No.121 of 2024 Criminal Case
No.1087 of 2024 (Case Crime No.08 of 2022)
State vs. Ajay Kshetri & others for the offence
punishable under Sections 395, 397, 447, 448,
452, 427, 412, 323, 506, 420, 467, 468, 471, 34
& 120-B of IPC, Police Station Clement town
pending before the court of 4th Additional
Sessions Judge, Dehradun.

5. Admit.

6. Issue notice to respondent no.2 returnable
at an early date.

7. Steps to be taken within one week.

8. Let the objection be filed by the State
within two weeks.

9. List on 01.09.2025.

10. Having heard learned counsel for the
parties, as an interim measure, till the next date
of listing, further proceedings of Sessions Trial
No.121 of 2024, Criminal Case No.1087 of
2024 (Case Crime No.08 of 2022) State vs. Ajay
Kshetri & others for the offence punishable
under Sections 395, 397, 447, 448, 452, 427,
412, 323, 506, 420, 467, 468, 471, 34 & 120-B
of IPC pending before the court of 4th Additional
Sessions Judge, Dehradun shall remain stayed.
