Mr. Ashish Aggarwal, learned counsel for the
Applicants.

2. Mr. Vipul Painuly, learned AGA assisted by
Mr. Chitrarth Kandpal, learned Brief Holder for the
State.

3. Mr. Shankar Aggarwal, learned counsel for
respondent no.2.

4. This criminal misc. application is filed under
Section 528 of B.N.S.S. by the Applicants for
quashing of the charge-sheet dated 31.03.2022,
summoning order dated 19.12.2024 as well as the
entire proceedings of Criminal Case No.9373 of
2024 (Case Crime No.407 of 2021), titled as “State
of Uttarakhand vs. Mukesh Kumar & Others

pending in the court of Chief Judicial Magistrate,
District Dehradun for the offence punishable under
Sections 323, 498-A, 504 & 506 of IPC and Section
3
/4 of Dowry Prohibition Act, at P.S. Patel Nagar,
District Dehradun, in view of the compromise
arrived at between the parties.

5. The Coordinate Bench of this Court vide
order dated 16.05.2025 directed the parties to
appear before the Secretary, District Legal Services
Authority, District Dehradun, who in turn, would
take their Aadhar Cards for identification and will
verify and authenticate the contents of the
compounding application by recording the
statements of the parties.

6. Learned Secretary, District Legal Services
Authority, District Dehradun has submitted his
report dated 13.06.2025, which is part of the record,
which clearly indicates that the parties have settled
the dispute amicably and Respondent no.2 Smt.
2025:UHC:5243
Indu does not wish to prosecute the Applicants and
the Secretary concerned has also verified the
contents of the compromise.

7. In view of the above, Compounding
Application (IA No.01 of 2025) is allowed. As a
consequence thereof, the charge-sheet dated
31.03.2022, summoning order dated 19.12.2024 as
well as the entire proceedings of Criminal Case
No.9373 of 2024 (Case Crime No.407 of 2021),
titled as “State of Uttarakhand vs. Mukesh Kumar
& Others
” pending in the court of Chief Judicial
Magistrate, District Dehradun for the offence
punishable under Sections 323, 498-A, 504 & 506
of IPC and Section 3/4 of Dowry Prohibition Act, at
P.S. Patel Nagar, District Dehradun, are hereby
quashed.

8. Present Criminal Misc. Application u/s 528
of B.N.S.S. is, thus, disposed of in terms of the
compromise arrived at between the parties.
