Mr. Gaurav Singh, learned counsel for the
Applicants.
2. Mr. G.C. Joshi, learned A.G.A. for the State of
Uttarakhand.
3. This C528 application has been filed for
quashing the summoning order, charge sheet, and
the consequential proceedings with regard to Charge
Sheet No. 01/2022 dated 16.12.2022 (FIR dated
16.04.2022), registered as FIR/Case Crime No. 431
of 2022 for offence punishable under Sections 498A,
323, 504 and 506 of the Indian Penal Code, 1860,
and under Sections 3/4 of the Dowry Prohibition Act,
1961, which are being proceeded against Applicant
Nos. 1 to 4 and under Sections 498A, 323, 354, 504,
506 IPC and Section 3/4 of Dowry Prohibition Act,
1961 against the Applicant No. 5.
4. Mr. Gaurav Singh, learned counsel for the
Applicants, submits that there is a possibility of a
compromise between the parties (Applicant Nos. 1 to
5 and Respondent no. 2).
5. Admit.
6. In view of the above, this Court is of the opinion
that the presence of Respondent No. 2 is required.
7. Issue notice to Respondent No. 2.
8. Steps for service be taken within one week.
9. List this case on 15.07.2025.
10. Counter affidavit, if any, may be filed in the
meantime.
11. Till the next date of listing, the entire
proceedings of Criminal Case No. 1983 of 2024,
“State vs. Jabbar and Others,” for offence punishable
under Sections 498A, 323, 504, and 506 of the
Indian Penal Code, 1860, and Sections 3/4 of the
Dowry Prohibition Act, 1961, insofar as they relate to
Applicant Nos. 1 to 4, and under Sections 498A, 323,
354, 504, and 506 of the IPC and Sections 3/4 of the
Dowry Prohibition Act, 1961, insofar as they relate to
Applicant No. 5, registered at Police Station Kotwali
Manglour, District Haridwar, and pending before the
Court of the learned Judicial Magistrate-I, Roorkee,
District Haridwar, shall remain stayed.
12. The Stay Application (IA No. 1 of 2024) is
disposed of accordingly.
