3. This C528 application has been filed for quashing the
Charge-sheet dated 05.04.2023, the summoning order
dated 06.04.2023 and the entire proceedings of S.S.T. No.
19 of 2023, “State vs. Sanjeev Chaturvedi and Others”, for
the offence punishable under Sections 409, 420, 467, 468,
471, 120B IPC and Sections 3/4 of the Uttar Pradesh Public
Examination (Prevention of Unfair Means) Act, 1998,
registered at Police Station Kankhal, District Haridwar,
pending before the Court of Ist Additional Sessions Judge,
Dehradun, District Dehradun.
4. Admit.
5. In view of the matter, this Court is of the opinion that
the presence of the Respondent no. 2 is required.
6. Issue notice to the Respondent no. 2.
7. Steps to be taken within a week.
8. List this case on 22.07.2025.
9. Counter affidavit, if any, may be filed meanwhile.
10. Till the next date of listing, the entire proceedings of
S.S.T. No. 19 of 2023, “State vs. Sanjeev Chaturvedi and
Others”, for the offence punishable under Sections 409, 420,
467, 468, 471, 120B IPC and Sections 3/4 of the Uttar
Pradesh Public Examination (Prevention of Unfair Means)
Act, 1998, registered at Police Station Kankhal, District
Haridwar, pending before the Court of Ist Additional Sessions
Judge, Dehradun, District Dehradun, shall remain stayed.
