Leave granted.

The Central Bureau of Investigation is the appellant before

us. It is aggrieved by the order dated 09.09.2024 passed by the

High Court of Delhi in Bail Application No. 2040/2024, whereby the

respondent, Dheeraj Wadhawan, was granted bail on medical grounds

in connection with First Information Report No. RC2242022A0001

dated 20.06.2022 registered with the CBI, AC-VI/SIT, New Delhi, for

the offence(s) punishable under Sections 409, 420, 477A and 120B of

the Indian Penal Code, 1860 and Section 13(2) read with Section

13(1)(d) of the Prevention of Corruption Act, 1988.

By order dated 23.05.2025, this Court noted the fact that the

respondent, Dheeraj Wadhawa, had secured bail on medical grounds

and opined that it would be necessary to ascertain the status of

his health presently. He was, accordingly, referred for examination

constituted by the Superintendent of the Grant Government Medical

College and Sir J J Group of Hospitals, Mumbai, Maharashtra.

Pursuant to the said order, a team of 11 Doctors undertook the

physical examination of the respondent, Dheeraj Wadhawan, and

furnished report dated 09.07.2025. The health parameters of the

respondent, Dheeraj Wadhawan, under the heads of General Medicine,

Dermatology, General Surgery, Psychiatry, Cardiology, Pulmonary

Medicine, ENT, Neurosurgery, Urology, Nephrology and Orthopedics

were examined and the Committee opined that there was no necessity

for hospitalization of the respondent, Dheeraj Wadhawan, at present

and all that was required was continuation of ongoing medication

apart from physiotherapy and back strengthening exercises. The

final conclusion of the Committee was that the respondent, Dheeraj

Wadhawan, required regular and periodic follow-up with various

departments for his spinal ailments and also required to continue

physiotherapy as part of his treatment plan on an outpatient basis

with other concerned specialists for his ongoing medical

conditions.

In the light of the aforestated report, it is clear that the

respondent, Dheeraj Wadhawan, does not need to attend the hospital

on a daily basis, whereby he could assert entitlement to

continuation of the bail granted to him on medical grounds. All

that is required as per the aforestated report of the Committee is

that he should follow up periodically with the Doctors concerned.

We, therefore, see no good grounds to continue the bail

granted on medical grounds to the respondent, Dheeraj Wadhawan, by

the High Court of Delhi.

Needless to state, if and when the respondent, Dheeraj

Wadhawan, requires any urgent or any specialist treatment, the jail

authorities and the CBI shall ensure that he is provided such

treatment immediately.

Subject to the above, the appeal is allowed and the order

dated 09.09.2024 passed by the High Court of Delhi at New Delhi in

Bail Application No. 2040/2024 is set aside.

The respondent, Dheeraj Wadhawan, shall surrender within a

period of two weeks from today.

We, however, clarify that this order has been passed only on

consideration of the medical grounds on the strength of which the

respondent, Dheeraj Wadhawan, secured bail from the High Court and

we have not gone into the merits of the matter.

Pending application(s), if any, shall stand disposed of.
