2. Records have been placed before this Court to

consider the prayer of the appellant for suspension of his

sentence and release on bail during pendency of the appeal.

3. The appellant has been convicted vide judgment

dated 10.06.2024 and sentenced vide order dated 11.06.2024

passed by learned Additional Sessions Judge-II, Patna for the

offence under Sections 302, 201 and 363 of the Indian Penal

Code (in short ‘IPC’) in Sessions Trial Case/CIS No. 05 of 2021

arising out of Pirbahore P.S. Case No. 709 of 2018. He has been

ordered to undergo life imprisonment with a fine of Rs. 50,000/-

under Section 302 of the Indian Penal Code and in default of
Patna High Court CR. APP (DB) No.927 of 2024(4) dt.22-04-2025

payment of fine, he shall further undergo simple imprisonment

for three years. Further, he has been sentenced to undergo

rigorous imprisonment for seven years with a fine of Rs. 10,000/-

under Section 363 of IPC and in default of fine, he shall further

undergo simple imprisonment for one year. Further, he has been

sentenced to undergo rigorous imprisonment for seven years with

a fine of Rs. 10,000/- under Section 201 of IPC and in default of

fine, he shall further undergo simple imprisonment for one year.

All the sentences are to run concurrently.
