1. Heard Mr. Jitendra Shankar Singh, learned counsel for
the petitioner, Mrs. Nehala Sharmin, learned Spl. PP for the
State and Mr. Ajit Kumar, Senior Counsel for the O.P. No.2.
2. During the course of submission, a number of
arguments were raised on behalf of the petitioner as well as
learned counsel for O.P. No.2 on the point of maintainability
of the criminal case pending before this Court.
3. However, after advancing some argument, learned
counsel for the petitioner seeks permission to convert this Cr.
Revision Application into an application filed under Section
528 of Bharatiya Nagarik Suraksha Sanhita, 2023 in course
of the day.
4. Accordingly, learned counsel for the petitioner is
permitted to convert this Criminal Revision Application into
an application to be filed under Section 528 of Bharatiya
Nagarik Suraksha Sanhita, 2023.
5. Office is directed to place the matter accordingly as per

Roster at once.
6. The learned counsel for the petitioner will be at liberty
to move before the Appropriate Bench as per Roster for the
early listing of the instant case.
