1. Heard learned counsel for the appellant and learned AGA for the State as well as perused the records.

The instant Criminal Appeal under Section 374 (2), Cr.P.C. has been moved on behalf of the appellant-Chhatra Pal S/o Mahabeer against the judgment and order dated 25.11.2006 passed by the Additional Session Judge, Fast Track Court No. 3, Sitapur in Session Trial No. 743 of 2003, arising out of Case Crime No. 214 of 2002, P.S.-Tambaur, District-Sitapur, convicting and sentencing the appellant under Section 304(Part-I) IPC read with Section 304 I.P.C. for a period of ten years rigorous imprisonment and fine of Rs. 5,000/- each and in default of payment of fine, further to undergo six months additional simple imprisonment.
