1. These two petitions are inter-connected and for same

reasons; counsels are same, therefore, with the consent of the

parties, both are heard together and are decided by this common

order.

S.B. Criminal Misc(Pet.) No. 4730/2023

2. This petition is filed for quashing of the FIR No.103/2023

lodged at Police Station JNV, Bikaner for offence under Section

341, 452, 354, 506 and 143 of IPC. The FIR is recital of an

incident which took place on 08.03.2023 when the complainant

Shyam Lal was out of the house and at that time there was no

male member in the family and suddenly the accused, having

common object and preparation to commit an offence, entered

into his house and caused injuries to his mother Shankri Devi and

wife Suman. There are allegations of outraging modesty and

snatching the ornaments. The matter was thoroughly investigated

and as per the factual report dated 21.01.2025 submitted by

learned public prosecutor, necessary evidence was collected while

conducting investigation including the video footage claiming

capturing of the crime scene. After a thorough investigation, the

allegations for committing offence under Section 341, 323, 452,

354 506 & 143 of IPC are found correct and accordingly, notices

under Section 41A of the Cr.P.C. were supplied to them. The

charge-sheet number 422/23.12.2023 has been chalked out. The

matter was again investigated for the purpose of verification by

[2025:RJ-JD:17629] (4 of 6) [CRLMP-4730/2023]

Additional Superintendent of Police, City Bikaner and he approved

the opinion of the Investigating Officer and now only the result of

investigation is to be submitted in the Court. Learned counsel

submits that the allegations in the FIR are patently false as no

such incident took place and the FIR has been lodged only with a

view to mount pressure upon them. A specific plea has been

raised that one FIR No.102 was also lodged in this regard and

thus, there was mela fide intention of the complainant. No further

grounds are submitted.
