1. Heard learned senior counsel for the
appellant.
2. No one has put in appearance on behalf of
the respondent despite service.
3. The present appeal would call in question
the order passed by the High Court dismissing the
appeal preferred by the department as not
maintainable and at the same time, reserving
liberty in favour of the appellant to prefer an
appeal before this Court.
