This appeal is by the Accused before the trial
court, who suffered the judgment of conviction for the
offence punishable U/Sec.138 of NI Act passed by
XIV Addl. CMM Court, Mayohall Unit, Bengaluru, in
CC.No.50476/2019, dtd. 19.2.2024, challenging the
validity of the judgment.

2. For the sake of convenience the parties
hereinafter will be referred to with their ranking
assigned before the trial court.

3. The facts of the case:-

The Complainant initiated private complaint
under Section 200 of Cr.P.C., against the Accused for
the offence punishable under Sec.138 of Negotiable
Instruments Act on the ground that the land bearing
Sy.No.58, New Sy. No.58/1 of Kyalasanahalli
Village, K.R. Puram Hobli, Bengaluru East Tq.,
measuring 39.08 guntas belongs to the joint family of
the Complainant. The Complainant’s great grand
father Pillaiah @ Byrathi Pillappa @ Pilla Reddy along
with his children 1) Venkataswamy Reddy, 2)
Ramareddy 3) Krishnareddy and 4) Lakshman
Reddy continued in possession cultivating it
personally. Pillaiah @ Byrathi Pillappa died intestate
on 17.01.2007.
