Order No.07 Dated- 08.08.2025

Heard the parties.

Apprehending his arrest in connection with Ahilyapur
P.S. Case No.47 of 2023, Cyber Case No. 03 of 2024 instituted for
the offences punishable under Sections 411, 414, 419, 420, 467,
468, 471, 120(B) & 34 of the Indian Penal Code and Section
66B
/66C/66D of the Information Technology Act, the petitioner
has moved this Court for grant of privileges of anticipatory bail.

The learned counsel appearing for the petitioner submits
that the allegation against the petitioner is that the petitioner was
involved in committing cyber-crime and duped money from
innocent account holders of banks and transferred the same to
fake bank accounts. It is submitted that the allegation against the
petitioner is false. It is next submitted that the petitioner has been
implicated in this case only due to village politics. It is also
submitted that there is no money trail, to implicate the petitioner
in this case. It is further submitted that co-accused persons, with
similar allegations, have already been given the privileges of
anticipatory bail by this court vide orders dated 24.02.2025
passed in A.B.A. No.3711 of 2024 and 12.03.2025 passed in
A.B.A. No.1684 of 2025. It is lastly submitted that petitioner
undertakes to cooperate with the investigation of the case and to
furnish sufficient security including cash security. Hence, it is
submitted that the petitioner be given the privileges of
anticipatory bail.

The learned Addl. P.P. appearing for the State opposes the
prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the
facts and circumstances stated above, I am inclined to grant
privileges of anticipatory bail to the petitioner. Accordingly, the
petitioner is directed to surrender in the Court below within six
weeks from the date of the order and in the event of his arrest or
surrendering, he will be enlarged on bail on depositing
Rs.10,000/- as cash security and on furnishing bail bond of
Rs.25,000/- (Twenty five thousand) with two sureties of the like
amount each to the satisfaction of learned Additional Sessions
Judge-IIcum-Spl. Judge (Cyber Crime), Giridih in connection
with Ahilyapur P.S. Case No.47 of 2023, Cyber Case No. 03 of
2024 with the condition that he will co-operate with the
investigation of the case and appear before the investigating
officer as and when noticed by him and furnish his mobile
number and photocopy of the Aadhar Card with an undertaking
that he will not change his mobile number during the pendency
of the case and further conditions as laid down under Section
