Heard Mr. Serto T. Kom, learned counsel appearing for the
petitioner through VC and Mr. Y. Ashang, learned Sr. counsel appearing for
the respondents.
The present application has been filed u/s 482 BNSS, 2023
praying for granting Anticipatory Bail in connection with FIR No. 14(8)2024
SKL-PS u/s 103(1), 3(5) BNS & u/s 3 Explosive Subs. Act. of Saikul Police
Station, Manipur
Vide order dated 10.10.2024, the petitioner was released on
interim bail by this Court.
Operative portion of order dated 10.10.2024 is reproduced
herein below;
“In the interim, it is hereby ordered that if the petitioner is arrested
by the police in connection with FIR Case No. 14(8)2024 SKL-PS
U/S 103 (1), 3(5) BNS & u/s 3 Explosive Subs. Act of Saikul Police
Station, Manipur before the next date of hearing, he shall be
released on bail on his furnishing a bail bond of Rs. 50000/-
(Rupees Fifty thousand) with one surety (Government employee) to
the satisfaction of the Arresting Authority. It is also made clear that
the petitioner should co-operate with the investigation and he
should make himself available for interrogation by the I.O of the
FIR case as and when required. The petitioner should not leave the
State of Manipur without prior permission of the Arresting
Authority. It is further made clear that if the petitioner violates any
of the conditions given hereinabove, the respondents are at liberty
to approach this court for modification or cancellation of this interim
order.”
Mr. Y. Ashang, learned Sr. counsel appearing for the State
respondent submits that the interim order dated 10.10.2024 may be made
absolute by putting condition in the order that the accused/petitioner has to
co-operate with the I.O of the case in the investigation and to appear
before the I.O of the case as and when required, the petitioner should not
leave the State of Manipur without prior permission from the arresting
authority and if the petitioner violate the condition made herein liberty may
be given to the I.O of the case to approach this Hon’ble Court for
vacation/cancellation of the bail order.
In the facts and circumstances, interim order dated
10.10.2024 is made absolute with bail bond of Rs. 50,000/- with one surety
of the like amount to the satisfaction of the arresting authority with
direction to the petitioner to co-operate with the I.O of the case in the
investigation and appear before the I.O of the case as and when required
and not to temper the evidences of the case. The petitioner should not
leave the State of Manipur without prior permission from the arresting
authority. Further, liberty is given to the I.O of the case to approach this
Hon’ble Court for vacation/cancellation of the bail order, if the petitioner
violates any of the condition given above.
Accordingly, the present AB is disposed of.
