The Court :- The present petition has been filed for transfer of Title Suit
No. 14 of 2022 (earlier numbered as T.S. No. 9 of 2008) pending before the
learned 2nd Civil Judge, Senior Division at Barasat. Learned Counsel for the
petitioner submits that present suit was filed by the opposite party/respondent
in the year 2008. In the said suit, the application under Order 39 Rule 1 & 2 of
the Code of Civil Procedure was dismissed. Aggrieved of this the plaintiff filed
FMA 1111 of 2009 before this Court. Vide order dated 26 th July, 2011, while
disposing of the appeal inter alia passed direction to dispose of the suit in
question on or before 31st December, 2011.
