3. Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita,
2023 (hereinafter referred to as ‘B.N.S.S.’) (under Section 482 of the Code
of Criminal Procedure, 1973 (hereinafter referred to as ‘Cr.PC‘), has been
filed on behalf of the Petitioners for quashing of FIR No. 38/2020 under
Section 354/451/509/506/34 of the Indian Penal Code, 1860 (hereinafter
referred to as ‘IPC‘) registered at Police Station Sunlight Colony, South East
District, Delhi and all the consequential proceedings emanating therefrom.

4. Issue Notice.

5. On advance Notice, learned APP has appeared and accepts the Notice
on behalf of the State.

6. Brief facts of the case are that the Petitioners are the paternal family
members of the sister-in-law (Devrani) of the Respondent No.
2/Complainant. They had inter se dispute with the family of the
Complainant. On 11.02.2020, the Petitioners, who are in-laws of the
Respondent No. 2’s brother-in-law, had entered into her house and given the
beatings resulting in registration of the said FIR.

7. On the Complaint of the Respondent No.2/Complainant, FIR No.
38/2020 under Section 354/451/509/506/34, got registered at Police Station
Sunlight Colony, South East District, Delhi.

8. With the intervention of the family members, friends and respectable
members of the Society, the Petitioners and the Respondent No. 2 have
amicably settled all the disputes and differences between them and arrived at
Settlement vide Memorandum of Understanding (MOU) dated 24.10.2024.
It is settled between the parties in the Settlement that the parties would not
file any Complaint against each other and their respective family members,
in future and shall also withdraw all their Complaint cases, if any, against
each other.

9. Today, the Respondent No. 2, who is present in the Court, states that
she has no objection if the said FIR is quashed.

10. The Statement of the parties have already been recorded before the
learned Joint Registrar. They have entered into the Settlement voluntarily
and without any fear and coercion and undertake to remain bound by the
terms of the said Settlement.

11. Considering the nature of the allegations, which is essentially of
beating the Complainant and also the relationship and that the matter has
been compromised, the FIR No. 38/2020 under Section 354/451/509/506/34
registered at Police Station Sunlight Colony, Delhi and all the consequential
proceedings emanating therefrom are quashed.

12. The Petition is disposed of accordingly.
