Reason:
Maharashtra for the offences punishable under Sections 376,
2376(AB), 376(2)(j), 376(2)(n), 506 of the Indian Penal Code
and Sections 6, 8 & 12 of The POCSO Act. His application for
bail was dismissed by the High Court under the order impugned.
Being aggrieved, he approached this Court. He has already
undergone about one year in jail.
Heard learned senior counsel for the petitioner, the
respondent-State and the respondent no.2 who are appeared
today.
Notice has been issued in this matter on 28.04.2025 and
both the respondents are served. Despite this no counter
affidavit have been filed by both the respondents.
Considering the facts and circumstances of the case and
the other relevant factors, we are of the opinion that a case
of bail is made out for the petitioner.
Accordingly, the petitioner is directed to be released on
bail forthwith on the usual terms and conditions to be decided
by the concerned Court.
However, considering the nature of the case, we request
the Trial Court to expedite the trial.
The present petition shall stand disposed of in the above
terms along with all pending application(s).
