The Delhi High Court has passed an ex-parte ad interim order restraining Atul Greentech Private Limited (AGPL), a subsidiary of Atul Auto Limited, from using the trademark ‘MOBILI’, following a trademark infringement suit filed by M/s Exxon Mobil Corporation over its registered mark ‘Mobil’.
The court has directed AGPL and its parent entity to cease manufacturing, wholesaling, retailing, and marketing any products under the names ‘MOBILI’, ‘Mobili’, or ‘Mobili Swap’, or any mark deceptively similar to ExxonMobil’s trademark, until the next hearing scheduled for August 25, 2025.
As a result of the interim order, Atul Auto and AGPL will not be able to sell their electric vehicles under the aforementioned brand names.
In a regulatory filing, Atul Auto stated it is in the process of filing an appeal against the court’s order. “We are hopeful of a favourable outcome as the goods offered by the plaintiff and the defendants are completely different. We do not expect the said order to have any material financial impact on the Company at a later stage,” the company said.
