1. Heard learned counsel for the applicant and learned AGA for the State and perused the record.
2. The instant application has been filed for the following main relief:-
“Wherefore, it is most respectfully prayed that this Hon’ble Court may graciously be pleased to quash the Annexure No 1 case no. 157/2025 notice under section 130 B.N.SS dated 24.01.2025 passed by the Additional Police Commissioner/Executive Magistrate, Mahanagar Commissionerate, Lucknow, wirt to the proceeding initiated under section 126/135 B. N.SS, in the interest of justice.”
3. It is stated that on account of apprehension that the applicant may cause breach of peace, a notice was issued by the Additional Police Commissioner/ Executive Magistrate, Mahanagar Commissionerate, District- Lucknow in the light of provisions indicated under Section 126/135 of BNSS.
