2. The petitioners seek pre-arrest bail in connection
with Neemchak Bathani P.S. Case No. 141 of 2023 registered
for the offence(s) punishable under Sections 147, 148, 149, 323,
341, 504, 506, 337, 338, 324 and 307 of the Indian Penal Code.
3. As per the allegation made in the FIR, the accused
persons named therein including the petitioners fought against
other community on the occasion of Muharram festival and
both the sides were indulged in brick batting and assaulting each
other.
4. Learned counsel appearing on behalf of the
petitioners submitted that petitioners are innocent and have
falsely been implicated in the present case. There is no specific
allegation against the petitioners as the allegation is general and
omnibus. It is further submitted that now good feelings and
harmony has been restored between the parties and they have
compromised the case too.
5. In the facts and circumstances of the case, the
petitioners, above named, are directed to be released on pre-
arrest bail, in the event of their arrest or surrender before the
Court below within a period of four weeks from today, on
furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand)

each with two sureties of the like amount each to the satisfaction
of learned J.M. 1st Class, Gaya in connection with Neemchak
Bathani P.S. Case No. 141 of 2023, subject to the conditions as
laid down under Section 438(2) of the Cr.P.C.
