                                                                ORDER
1] They are heard and perused the case diary.
                          2] This is the applicant’s first bail application filed under Section 483 of
                          Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of Cr.P.C. as he is
                          implicated in connection with Crime No.864/2022 registered at Police
                          Station Kukshi District Dhar (M.P.) for offence punishable under Section
                          294/120(B)/506/149/427/397/395/307/365/353/332/109           and      section
                          34(2),/42/40(1) of M.P. Excise Act, 1915. The applicant is in custody since
                          8.6.2025.
                          3]      The allegation against the applicant is of his involvement in the
                          aforesaid case wherein 7522.2 bulk liters of unauthorised liquor has been
                          seized from the possession of the co-accused Sukhram and it is alleged that
                          the applicant, being the Manager of the licencee shop, had loaded the liquor
                          in the truck.
                          4]      Counsel for the applicant has submitted that the owner of the shop
                          Sukhram against whom it is alleged that he had abducted the SDM has
                          already been granted bail by the coordinate Bench of this Court passed in
                          MCRC No.53384/2023 vide order dated 2.1.2024 and the other co-accused

                          persons, have also been granted bail by the coordinate Bench of this Court,
                          whose bail orders have been filed on record. It is further submitted that the
                          applicant has been apprehended subsequently, and he is lodged in jail since
                          8.6.2025, and the final conclusion of the trial is likely to take sufficient long
                          time, and there is no active involvement against him in the transportation of
                          the aforesaid liquor or in the assault on the SDM. Thus, it is prayed that the
                          application be allowed.
                          5] Counsel for the State has opposed the prayer.
                          6] On due consideration of submissions and on perusal of the case diary
                          and the fact that the applicant is lodged in jail since 8.6.2025, and the final
                          conclusion of the trial will take sufficient long time and his role is limited to
                          loading the liquor in the truck, this Court is inclined to allow the present
                          application.
                          7] Accordingly, without commenting on the merits of the case, the
                          application filed by the applicant is hereby allowed. The applicant is directed
                          to be released on bail upon furnishing a personal bond in the sum of
                          Rs.25,000/- (Rupees Twenty Five Thousand) with one solvent surety of the
                          like amount to the satisfaction of the trial Court for his/her regular
                          appearance before the trial Court during trial with a condition that he / she
                          shall remain present before the court concerned during trial and shall also
                          abide by the conditions enumerated under Section 437 (3) Criminal
                          Procedure Code, 1973..
                          8] Accordingly, the application is allowed and disposed of.
