1. Heard Sri Arvind Singh, learned counsel for the applicants in the leading and the connected applications as well as Sri J.P. Gupta, learned AGA for the State.

The facts of the leading application are that on 17.12.2022 proceedings came to be initiated under Section 156(3) of the Cr.P.C. by the opposite party no. 2 against the applicant under Section 376 IPC read with Section 4/8 of the POCSO Act, 2012 with an allegation that the victim/complainant was a student of class 10th in the academic year 2018-19 and she came in contact with the applicant herein who was the resident of the same village and they had friendship with each other and the applicant herein allured the opposite party no. 2-victim that he would marry her and while misguiding and creating all sorts of confusion and making false promises, he entered into physical relationship with the victim and when pressure was being mounted post completion of class 12th for getting the marriage solemnized then the applicant refused to get married then the said fact was apprised to the parents of the victim and the parents of the victim approached the applicant’s parents for marriage but the same was refused and in the year 2021 the marriage of the victim stood solemnized with one Arvind. However, post marriage when the victim started a new life then the applicant herein came to the matrimonial house of the opposite party no. 2-victim and showed the videos and pictures depicting intimacy and physical relationship of the applicant with the opposite party no. 2 and also the allegation is that the applicant had threatened the opposite party no. 2 that neither he would marry the opposite party no. 2 nor he would let the opposite party no. 2 either solemnized or lead a married life. He also threatened that, in case, the victim did not have physical relationship with the applicant then he would get it loaded in the social media so that the entire world would see. Allegation is that an amount of Rs. 2,50,000/- was being demanded to get the things on a right track on account whereof the victim sustained mental injuries and a complaint was also lodged through registered post on 09.12.2022 before the Superintendent of Police, Sonebhadra and in failing to lodge any FIR, the proceedings under Section 156(3) Cr.P.C. stood triggered on 17.12.2022. Post recording of the statements under Section 200 of the victim/complainant and of one Ishwari under Section 202 and Deepak Soni under Section 202, the applicant came to be summoned on 11.07.2024 by the Court of Additional Session Judge/Special Judge (POCSO ) Act, Sonebhadra in Complaint Case No. 8 of 2023 under Section 376(2)n IPC read with Section 5L/6 of the POCSO Act.
