1. Heard Mr. B. P. Borah, learned counsel for the petitioner.
Also heard Mr. K.K. Das, learned Additional Public Prosecutor for the
State.
2. This application under Section 482 of BNSS, 2023 has been
filed by the petitioner, namely, 1. Dhirendra Nath, who is

apprehending his arrest in connection with CID P.S Case No.
07/2025 registered under Sections
120(B)/166A/167/191/200/209/210/420 of IPC, R/W Section 98 of
Assam Police Act, 2007.
3. The gist of the accusation in this case is that on
25.04.2025, one Ali Kumar Dusad, Inspector of Police had lodged an
FIR before the Officer-in-Charge, CID P.S, inter alia, alleging that on
the basis of a FIR lodged at Palashbari TOP on 01.12.2023 in respect
of an accident which occurred in Udalguri. The petitioner is alleged
to have filed the charge-sheet illegally for getting wrongful gain in
respect of a connected Motor Accident Claims case.
