1. This matter is taken up through Hybrid Arrangement
(Virtual /Physical Mode).

2. Heard learned counsel for the Petitioner and learned Addl.
Standing Counsel for the State. Perused the records.

3. Considering the submissions of the learned counsels for
the respective parties, the order dated 19.11.2024 is recalled and
the following order is passed.

4. This is an application under Section 438, Cr.P.C. filed by
the Petitioner for anticipatory bail, involving offence punishable
under Sections 147, 148, 302/149 of the Indian Penal Code and
Section 25 and 27 of the Arms Act in G.R.Case No.05 of 2016
arising out of Pipili P.S.Case No.05 of 2016 of the Court of
learned A.D.J.-III-cum-Special Judge, Special Court,
Bhubaneswar.

5. Considering the submissions of the learned counsel for the
parties, it is observed that the Petitioner, if so advised, may
surrender before the learned A.D.J.-III-cum-Special Judge,
Special Court, Bhubaneswar in the aforesaid case within four
weeks from today. In the event the Petitioner surrenders and
moves for bail within the aforesaid period, learned A.D.J.-III-
cum-Special Judge, Special Court, Bhubaneswar shall do well to
dispose of the bail application of the Petitioner on the same
day on merit in accordance with law. The case diary be made
available to the concerned court to facilitate disposal of the bail
application of the Petitioner.

6. The ABLAPL is disposed of accordingly.

7. Urgent certified copy of this order be granted as per rules.
