DIFFENCE BETWEEN OLD LAW AND NEW LAW

Before ipc came into force every citizen of india only followed their personal laws and their was no universal code which followed by all and that was unconditional , inconsistent so ipc came into force and it was drafted land.

The timeline of drafting of ipc

in 1834 1st draft of ipc was drafted and then it presented before goverment general in 1937 after 20 years of gap it was presented before legistative council in 1856, and finally ipc was enacted in 1860 come into force 1862, and then between 1862 -2018 it was amended new reform in ipc was added but in 2023 its Bharatiya nyaya sanhita replace indian penal code.

New criminal law timeline

Goverment give power to national law university delhi to draft the new criminal law and the vice chancellor of NLV delhi at the time was skd rao and commity known as commity for reform criminal law and the commity forward the recommandation in 2022 to ministry of home affairs in 11 august 2023 amit shah was present the new criminal laws in loksabha ,and in 1st july 2024 the 3 criminal laws came into force.

Major Changes

1- separate chapter for protection children and womens

2-20 new offences have been added in BNS.

3-19 provision of ipc deleted in BNS

4-in 33 offences punishment of imprisonment has been increased

5-in 83 offences the punishment fire has been enhance

6-in 23 offences the mandatory minimum punishment has been introduced 

7-new punishment introduced that is community service

8-definition of child is introduced 

9-thansgender is included in the definition of gender 

10-electronic and digital record are included in the definition of document

11-new chapter incohate offence is introduced

12-new offence are introduced that are-

a-terrorist act

b-petty organised crime

c-hit and run

d-hiring child to commit offence

e-sexual exploitation of women by decietful

f-snatching

g-abetment outside

h-act endangering the sovereignty integrity unit of india

i-mob lyching 

j-publication false and fake news

13-abetment of suicide is deleted

14- in the definition of grievous hurt the number of days has been reduced from 20 to 15

15-community service is provided as a punishment for theft of less than RS-5000
