                  Criminal Petition No.6613 of 2025
Order:

       This Criminal Petition is filed by the petitioner/accused No.4

under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)

seeking to quash the proceedings in Crime No.312 of 2025 on the file of

Station House Officer, Madhura Nagar Police Station, Hyderabad,

registered for the offences punishable under Sections 79, 115(2), 126(2)

and 304 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023.


2.     Heard learned counsel for the petitioner and Sri V.Jithender Rao,

learned Assistant Public Prosecutor appearing for the respondent

No.1/State.

3. During the course of hearing, it is brought to the notice of this

Court that the offences levelled against the petitioner are punishable

with an imprisonment of less than seven years.

4. In view of the same, without going into the merits of the case, this

Court deems it appropriate to direct the Investigating Officer to

scrupulously follow the procedure contemplated under Section 41-A of the

Criminal Procedure Code, 1973 (Cr.P.C.)/Section 35(3) of BNSS and the

guidelines issued by the Hon’ble Apex Court in Arnesh Kumar Vs State

of Bihar 1. On such notice being given, the petitioner/accused No.4 shall

appear before the concerned Investigating Officer as and when directed.

The concerned Investigating Officer is directed to permit the

petitioner/accused No.4 to take assistance of the lawyer during the course

of investigation.

5. It is made clear that the petitioner/accused No.4 shall cooperate

with the Investigating Officer for the investigation and make himself

available to him as and when required and also provide the

information/documents as sought by him to conclude the investigation.

6. If the petitioner/accused No.4 fails to cooperate with the

Investigating Officer for investigation, the Investigating Officer is at

liberty to take action against him in accordance with law.

7. Subject to the above directions, the Criminal Petition is disposed

of. As a sequel, miscellaneous petitions, pending if any, stand closed.
