Heard Mr. N. Ibotomb, learned Sr. counsel assisted by Mr.
Ningtamba, learned counsel appearing for the petitioner.
Issue notice returnable within 4(four) weeks.
Ms. Jotibala, learned counsel assisting Mr. BP Sahu, learned Sr.
counsel entered appearance and accepts notice on behalf of respondent
No. 2; and Ms. Urmila, learned counsel entered appearance and accepts
notice on behalf of respondent no. 1, hence no formal notice is called for.
The case of the petitioner is that the constitution of the
Selection Committee/Board was not as the per provision under statute
19(2) of the statute of the University under the schedule to the Manipur
University Act, 2005 and as such, the selection process is illegal and the
same is vitiated. The learned Sr. counsel accordingly prays for passing
interim order directing the authorities not to declare the result of the said
selection impugned in the present writ petition.
Mr. BP Sahu, learned Sr. counsel appearing for the Manipur
University submitted that the earlier provision of the said Act has been
subsequently amended and the accent of the President has already been

obtained. The learned Sr. counsel further submitted that as per the
amended provision, the selection committee of the board has been
constituted and there is no illegality.
In response to the submission, it has been submitted by Mr. N.
Ibotombi, learned Sr. counsel appearing for the petitioner that the
amended provision of the Manipur University Act, 2005 has not been
notified in the Gazette as required under section 46 of the Manipur
University Act, 2005 and as such the amended act has not yet been
enforced in terms of the relevant provision of the act.
Mr. BP Sahu, learned Sr. counsel appearing for the Manipur
University seeks 1(one) week time to get instruction as to whether the
amended provision of the act has been notified in the Gazette or not.
As prayed for by the learned Sr. counsel appearing for the
respondent no. 2, list these cases again on 30.07.2025 for consideration
of the prayer for passing interim order.
In the meantime and till the next date of hearing the
respondents are directed not to declare the result of the said selection for
the post of Registrar of the Manipur University.
A copy of this order be furnished to both the learned counsel
appearing for the parties through their whatsapp/email for doing the
needful.
Registry is directed to reflect the name of Mr. W. Darakishwor
in the cause list.
