1. Supplementary affidavit, filed by learned counsel for the applicant, is taken on record.

2. Heard Sri Sri Ankit Kumar, advocate holding brief of Sri Namit Kr. Sharma, learned counsel for the applicant, Sri Ajeet Kr. Chaurasiya, learned counsel for opposite party No.2 and learned A.G.A. for the State.

3. The instant application has been filed to quash the charge sheet dated 31.12.2021 in case crime No. 397 of 2021, under Section 420, 467, 468, 471 IPC, P.S. Raya, District Mathura whereupon cognizance has also been taken on 20.6.2022 as well as the entire proceeding of Case No. 16771 of 2022, pending before Judicial Magistrate, Xth, Mathura.

4. Facts giving rise to the present controversy is that opposite party No.2 lodged an F.I.R. against the applicant under Sections 420, 467, 468, 471 IPC wherein the police, after investigation, submitted charge sheet against the applicant under Sections 420, 467, 468, 471 IPC on 31.12.2021.
