Leave granted.

The appellant, Farida Begum Biswas, approached this Court

aggrieved by the judgment/order dated 29.04.2025, whereby the High

Court of Madhya Pradesh at Gwalior denied her anticipatory bail in

relation to Crime/First Information Report No1. 149/2025 registered

with Police Station City Kotwali, District – Bhind, Madhya Pradesh,

for the offence(s) punishable under Sections 420, 406, 409 and 34

of the Indian Penal Code, 1860.

The transaction which formed the basis of the aforestated FIR

of 2025 dates back to the year 2021. Keeping this aspect in mind,

this Court granted protection to the appellant, Farida Begum,

Biswas, on 16.05.2025, directing that she should not be arrested in

relation to the aforestated FIR, subject to the condition that she

joins and cooperates with the investigation.

Counter affidavit/reply having been filed by the State of

Madhya Pradesh, we find no reason to set aside the order of

protection granted to the appellant. We are informed that the

appellant appeared before the Investigating Officer and her

statement was also recorded. She shall, therefore, continue to

cooperate with the investigation and also abide by the conditions

stipulated in Section 482(2) of the Bharatiya Nagarik Suraksha

Sanhita, 2023.

Subject to the above, the appeal is allowed. In the event the

appellant, Farida Begum Biswas, is arrested in relation to the

aforestated FIR, she shall be released on bail by the

arresting/investigating officer/trial court on terms and conditions

to be fixed by the trial court.

We clarify that the observations made in this order are for

the disposal of the present appeal and for grant of anticipatory

bail and the same shall not be treated as an expression of opinion

on the merits of the case.

Pending application(s), if any, shall stand disposed of.
