1. Mr. Shafqat Nazir, Advocate appears and accepts notice on behalf of
respondent bank. He is directed to file reply/objections by the next date of
hearing.
2. Heard learned counsel for the petitioner in respect of his prayer for
grant of interim relief. Also heard learned counsel for the respondent bank in
rebuttal who, inter alia, submitted that there is no OTS scheme presently in
operation and, as such, the case of the petitioner cannot be considered.
3. Considered the rival submissions of learned counsel for the parties.
4. List on 29th July, 2025.
5. In the meantime, subject to any vacation or modification upon the
consideration of objections/arguments and till next date of hearing before the
bench, the respondent bank, without prejudice to the proceedings reported to
have been already initiated by it under the SARFAESI Act, shall consider the
willingness of the petitioner for availing the relevant OTS scheme of the
respondent bank, if any in operation, in which process the petitioner be
afforded an opportunity of being heard.
