1. This application has been filed for quashing the criminal

proceedings pending before the learned Addl. Sessions Judge-cum-

Spl. Judge, Jajpur Road, where the petitioners had been charge

sheeted under Section 294,341,323,506,34,452, 354 of the IPC,

Section 3(1)(r), 3(1)(s), 3(2)(va) of the SC & ST Act in Korei P.S.

Case No. 161 of 2018 corresponding to C.T. Spl. Case No. 144 of

2018.

2. Mr. A. Mishra, learned counsel for the petitioner submits that

the matter has been settled between the parties for which a joint

compromise petition had been filed before the learned Court below.

As the offences under Section 323, 451 and 506 of IPC are

compoundable in nature, the application was partly allowed and the

petitioners had been acquitted from the said offences but the learned

Court below has directed that they will face trial for the remaining

offences.

3. Mr. A. Mishra, learned counsel further submits that since the

matter has been settled between the parties, if a short adjournment is

granted, the informant shall appear in the case and it is not necessary

to issue formal notice to opposite party No.2-the informant.

4. Considering the said submissions, list this case on 25.04.2025.

5. In the meanwhile, Mr. S. J. Mohanty, learned Addl. Standing

Counsel shall also obtain instructions from the I.O./IIC, Korei Police

Station regarding the settlement between the parties and if the same

is voluntary.
