1. The petitioner has filed this petition seeking the following relief(s):-

“1. That, the Hon’ble Court may kindly be pleased to
direct the respondent authorities to re-draw the
gradation list of the Revenue Inspector as on
01.04.2016 (Annexure R/1) placing the petitioner
above his juniors.

II. That, the Hon’ble Court may kindly be pleased to set
aside the promotion order dated 12.01.2018 (Annexure
P/2) granting promotion on the post of Naib Tehsildar
and the promotion order dated 12.01.2018 (Annexure
P/3) granting promotion on the post of Asst. Supt. Land
Record being violative of Article 14 and 16 of the
Constitution.

III. That, the Hon’ble Court may kindly be pleased to
direct the respondent authorities to consider the
candidature of the petitioner for promotion on the post
of Naib Tehsildar or Asst. Supt. Land Record (next
higher post for promotion of RI) in accordance with the
correct seniority of the petitioner in the gradation list of
RI cadre.

IV. Any other relief, which this Hon’ble Court deems, fit
in the facts and circumstances may also be granted in
favour of the petitioner.”

2. Learned counsel for the petitioner submits that at the relevant time i.e. in

2018, the petitioner was posted as Revenue Inspector in District-Janjgir-

Champa. He further submits that juniors to the petitioner was promoted to

the post of Naib Tehsildar vide order dated 12.01.2018. He further submits

that in the gradation list, names of petitioner was not placed at appropriate

place. He contends that subsequently the discrepancy in gradation list was

rectified but claim of petitioner was not considered for promotion. He further

submits that petitioner has superannuated and if the claim of petitioner is

considered, he would get notional benefits including higher pension.

3. On the other hand, learned counsel appearing on behalf of respective

respondents oppose.

5. Taking into consideration the fact that petitioner has already superannuated

and juniors to him were promoted on 12.01.2018 to the post of Naib

Tehsildar, the present petition is hereby being disposed reserving liberty in

favor of petitioner to prefer separate representation before the Secretary,

Revenue Department ie. respondent No. 1 within period of 30 days from

today and the authority concerned is directed to decide the same strictly in

accordance with law within further period of 120 days from today.

6. With the aforesaid direction(s), these petitions stand disposed of.
