Th’ls Crim’lnaI Petition, under Sections 480 and 483 of the Bharatiya
Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused
No.1, seeking regular bail, in F,I.R.No.37 of 2025, on the file of Chintalapudi
Police Station, Eluru.
2. A case has been registered against the Petitioner herein for the Offence
punishable under section 69, 318(4), 351(2) r/w 3(5) of Bharatiya Nyaya
sanhitha, 2023 (for short lthe BNS Act’).
3. Case of the prosecution, in brief, iS that, the V’lCtim completed
graduation and her family members were searching for marr’lage alliances, in
that connection the petitioner/accused No|1 along with his family members
visited the house of the victim for marriage negotiations in the. month Of
september, 2024 and marriage was Settled between the Petitioner and the
victim and betrothal function was held on 17.10|2024 in the house of the
victim, After completion of the function, On that night, the Petitioner/Al
deceived the victim and had sexual intercourse and threatened her if she
discloses the incident to anybody, he will kill her. Thereafter, the petitioner/Al
and his family members demanded more money as dowry and refused to
marry the victim and the accused also lied about completion of MBA.

4. Learned counsel for the petitioner would submit that a false case has

been lodged against the petitioner. Learned counsel would further Submit that

the marriage was cancelled at the end of the family of the defacfo-cOmPlainant E=H
but not from the petit’loner’s side. Admittedly, the betrothal function Was held
on 17.10.2024. Learned counsel would further submit that the Petitioner has
been in judicial custody since o4.04.2025. Learned Counsel would further
submit that the petitioner is ready to furnish sureties to the satisfaction of the
court and by this time, most of the investigation may have been comple{ed-
The other accused in the present case Were given 41(A) notice. Learned
counsel for the petitioner finally prays to allow the petition by imposing any
conditions.
5. Learned Assistant Public Prosecutor would submit that investigation iS
pending for examination of some more witnesses and prays for dismissal of
the petition.
4. Heard Sri G.Pawan Kalayan, learned counsel forthe petitioner and Ms|
K. Priyanka Lakshmi, learned Assistant Public Prosecutor representing the
respondent/State.
5. Perused the material on record.
6. Now the point for determination is whether there are any justifiable
grounds to release the petitioner on bail.
7. Considering the submissions made, Since the Petitioner has been ln
judicial custody since o4|04.2025 and it appears crucial part Of investigation iS

completed and tampering of_evidence does not arise, this Court is inclined to
grant regular bail to the petitioner/Accused on the following conditions.
i) The petitioner/Accused No.1 shall be released on bail on his
executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only)
with two sureties of the like sum each to the satisfaction of the concerned
Magistrate Court.
ii) On release, the petitioner shall appear before the Station House
Officer concerned, twice in a week i.e., every Sunday and Wednesday
between 10:00 AM to 5:00 PM, until further ordersl
iii) The petitioner herein shall not directly or indirectly contact or threaten
the witnesses under any circumstances and any such attempt shall be
construed as an attempt to influence the witnesses and shall not tamper
evidence and shall cooperate with the investigation.
8. Accordingly, the Crim’lnal Petition is allowed.
As a sequel thereto, the miscellaneous applicationsJ if any, Pending in
this Criminal Petition shall stand closed. /
