This application for anticipatory bail under Section 482 of the

BNSS (old Section 438 Cr.P.C.) has been filed by the petitioner

apprehending his arrest in connection with F.I.R. No.51/2025,

registered at Police Station Sadar Bikaner, District – Bikaner for

offences under Sections 318(4), 316(2), 338, 336(3) & 340(2) of

the BNS.

Heard learned counsel for the petitioner, learned Public

Prosecutor and the learned counsel for the complainant. Perused

the material available on record.

Learned counsel for the petitioner submitted that a complaint

has been filed complainant Rajesh Kumar before the Additional

Chief Judicial Magistrate No.2, Bikaner against the accused

Jaskaran, Gurpreet Singh Saini and Mohit Chauhan (Ramanpal) to

the effect that the complainant prepares for competitive

examinations for government service. Accused Gurpreet Singh is

an acquaintance of the Shashikant who is Jija of the complainant

Rajesh Kumar. Said Gurpreet Singh stated that his brother-in-law

Jaskaran helps in getting Government jobs. He assured the

complainant to get a Government job. On his asking for arranging

money to give them, complaint’s father took a home loan of

Rs.15,00,000/- and transferred the said amount in the account of

Jaskaran and Mohit. They also transferred the remaining amount

as per their demand and bank statements of these transaction are

on record. Thus, a total amount of Rs.21,00,000/- has been

cheated from the complainant. Accused Jaskaran Singh along

with co-accused Parul Dhaka, Gurpreet Singh, Ramanpal @ Mohit

Couhan hatched a criminal conspiracy and prepared forged and

fabricated documents and gave forged joining letter and I-Card of

Income Tax Department, Dehli to complainant Rajesh Kumar. They

also undertook a false medical from Guru Teg Bahadur Hospital,

Delhi and thereafter got training to Rajesh Kumar in Vyapar

Bhawan, New Delhi and thus they have taken Rs.21,00,000/- from

the complainant Rajesh Kumar and cheated the complainant and

took away his hard earned money.

Learned counsel for the petitioner argued that accused-

petitioner has been falsely implicated in the present case. He has

not hatched any conspiracy with the co-accused Jaskaran, Parul

Dhaka, Ramanpal @ Mohit Couhan to cheat the complainant. He

has not received any amount from the complainant. The whole

story of the prosecution is false and concocted. He therefore,

prayed that the petitioner-accused may be enlarged on bail.

Per contra, learned Public Prosecutor and the learned counsel

for the complainant have vehemently opposed the bail application.

While submitting the factual report dated 21.04.2025, sent by

SHO, P.S. Sadar Bikaner, they submitted that accused has

committed a serious crime. Accused Gurpreet Singh is an

acquaintance of the Shashikant who is Jija of the complainant

Rajesh Kumar. Said Gurpreet Singh stated that his brother-in-law

Jaskaran helps in getting Government jobs. He assured the

complainant to get a Government job. On his asking for arranging

money to give them, complaint’s father took a home loan of

Rs.15,00,000/- and transferred the said amount in the account of

Jaskaran and Mohit. They also transferred the remaining amount

as per their demand and bank statements of these transaction are

on record. Thus, a total amount of Rs.21,00,000/- has been

cheated from the complainant. Accused Jaskaran Singh along with

co-accused persons namely – Parul Dhaka, Gurpreet Singh,

Ramanpal @ Mohit Couhan hatched a criminal conspiracy and

prepared forged and fabricated documents and gave forged

joining letter and I-Card of Income Tax Department, Dehli to

complainant Rajesh Kumar. They also undertook a false medical

from Guru Teg Bahadur Hospital, Delhi and thereafter got training

to Rajesh Kumar in Vyapar Bhawan, New Delhi and thus they have

taken Rs.21,00,000/- from the complainant Rajesh Kumar and

cheated him. Accused persons also gave joining letter and I-Card

to the witness Dushyant for the post of D.O. in the Jhansi Division

of the Indian Railways. He submitted that the investigation from

the present petitioner is pending. In case he is released on

anticipatory bail, there will be effect on the investigation.

Therefore, he prayed that looking to the gravity of the offence,

benefit of anticipatory bail may not be extended to the petitioner.

From perusal of the factual report, it is revealed that Accused

Gurpreet Singh was an acquaintance of the Shashikant who is Jija

of the complainant Rajesh Kumar. Said Gurpreet Singh stated that

his brother-in-law Jaskaran helps in getting Government jobs. He

assured the complainant to get a Government job. On his asking

for arranging money to give them, complaint’s father took a home

loan of Rs.15,00,000/- and transferred the said amount in the

account of Jaskaran and Mohit. They also transferred the

remaining amount as per their demand and bank statements of

these transaction are on record. Thus, a total amount of

Rs.21,00,000/- has been cheated from the complainant.

The investigation from the present petitioner is stated to be

pending. The role of the present petitioner will be ascertained

after the investigation.

Having regard to the facts and the circumstances of the

case, the anticipatory bail application filed on behalf of the

petitioner is rejected at this stage.

The factual report dated 21.04.2025 is taken on record.
